Terms of Use
Version 2026-11-02.
If you are in the United States: section 8 says disputes with Sepify are settled by individual arbitration, not in court, and that you can't bring or join a class action against Sepify. You can opt out within 30 days.
1. Who these terms are for
These terms apply to you if you use Sepify because of your work for a business that uses it (your "employer"): for example, punching in and out on a Sepify time clock, or signing in as a manager. They are between you and Sepify Inc., an Ontario corporation ("Sepify", "we"). Your employer has its own agreement with us, the Terms of Service.
You accept these terms when you tap or click to agree to them, or when you use Sepify after being shown them. If you don't agree, don't use Sepify; ask your employer how else to record your time.
2. Your employer is in charge of your work information
- Your employer decides how it uses Sepify, sets your PIN and punching method, and controls your hours, timesheets and pay. Sepify is not your employer and does not make decisions about your pay, hours or job.
- Questions about your hours, pay or punches go to your employer. To see, correct or delete your information, ask your employer; we help them do it.
- How your information is handled, including face check and punch photos, is explained in our Privacy Policy. Face check is only used if you agree to it on the time clock, and you can say no.
3. Using Sepify fairly
You agree to:
- punch in and out only for yourself, never for someone else;
- not try to fool the face check, the PIN check or the time on a punch;
- keep your PIN and password private and not share your sign-in;
- tell your employer right away if you think someone used your PIN or account;
- not access information you aren't allowed to see, or damage, copy or take apart the time clock or the software;
- use Sepify only for your work for your employer, and follow the law.
If you don't follow these terms, your employer or Sepify may stop your access.
4. Managers
If you sign in as an owner or manager, you act for your employer. Use only the access your employer gave you, handle staff information only for work, and keep your sign-in secure.
5. Our software
Sepify Inc. owns the Sepify software, design, name and logo. You may use them only as your employer allows and these terms describe.
6. Disclaimer
To the extent the law allows, Sepify is provided "as is" and "as available", without warranties of any kind. If a punch seems wrong or missing, tell your employer so they can correct it. Some places, including Quebec, don't allow certain warranty exclusions or limits; where that law applies to you, those parts of sections 6 and 7 don't apply and you may have other rights.
7. Limitation of liability
To the extent the law allows, Sepify is not liable to you for indirect, incidental, special, consequential or punitive damages. Claims about your wages, hours or employment are between you and your employer. Nothing in these terms limits any right you have under employment law or any other law that can't be limited by agreement.
8. Governing law and disputes
Before starting any formal dispute with Sepify, contact us at the address below and give us 30 days to try to resolve it.
Outside the United States: these terms are governed by the laws of Ontario and the federal laws of Canada that apply there, except where the law of the place you live gives you the right to use its law or its courts.
In the United States:
- These terms are governed by the Federal Arbitration Act and, otherwise, the laws of the State of New York, without regard to conflict-of-law rules.
- Any dispute between you and Sepify about Sepify or these terms, including claims about privacy or biometric information and whether this section applies, will be settled by binding individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules. The hearing will be held by video or phone, or in the county where you live. Sepify will pay the filing and arbitrator fees the AAA rules require a business to pay.
- No class actions and no jury: you and Sepify may bring claims against each other only individually, not as a plaintiff or class member in any class, collective or representative proceeding, and each of you gives up the right to a jury trial.
- You may still bring an individual claim in small-claims court, or report a concern to a government agency.
- Opting out: you can opt out of this arbitration section by emailing us within 30 days of first accepting these terms, with your name, your employer's name, and a statement that you opt out of arbitration. Opting out doesn't affect your job or how you can use Sepify.
- If the ban on class proceedings is found unenforceable for a claim, that claim goes to a court instead of arbitration. If we make a material change to this section, you can reject it by emailing us within 30 days, and the earlier version keeps applying to you.
- This section covers only disputes between you and Sepify. It doesn't change any agreement or rights between you and your employer.
9. Changes and general terms
We may update these terms. If we make a change that matters, you'll be shown the new terms before you're asked to agree to them again. If part of these terms is found unenforceable, the rest stays in force.
